The terms on which Epsolon Inc. makes this website available. Client work is governed by a separate signed agreement, which takes precedence over anything here.

These terms, and what they cover
By using this website you agree to these terms. They cover the website only. Any services we perform for you are governed by a separate written agreement — a proposal, statement of work or master services agreement — and where that agreement differs from this page, that agreement controls.
The website
We provide this site for information. We keep it accurate and current as best we can, but we do not warrant that it is free of errors or that it will always be available. We may change or withdraw any part of it without notice.
Nothing on this site is an offer to contract, a quotation, or professional advice for your particular circumstances. Descriptions of our products and capabilities are general; what we would actually deliver to you would be set out in a written proposal.
Acceptable use
You agree not to:
- Use the site for any unlawful purpose, or in breach of any applicable regulation.
- Attempt to gain unauthorised access to the site, its servers, or any connected system.
- Interfere with the site's operation, including through automated overloading or denial-of-service activity.
- Scrape, copy or republish substantial parts of the site for commercial purposes without our written consent.
Good-faith security research is welcome and is not a breach of these terms, provided it avoids privacy violations, data destruction and service disruption, and is reported to us as described on our Security page.
Enquiries you send us
When you contact us through this site, we use what you send only to respond to you, as described in our Privacy Policy. Please do not send confidential information through the contact form. Sending an enquiry does not create a contract or a confidential relationship between us; if you need confidentiality before we talk, tell us and we will put a non-disclosure agreement in place first.
Intellectual property
The content, design, and code of this site belong to Epsolon Inc. or its licensors. Our name and mark may not be used without our written permission.
Third-party platform, product and company names referenced on this site are the property of their respective owners. We reference them only to describe integration work we have performed. Their use does not imply any partnership with, sponsorship by, endorsement by, or affiliation with those owners.
Ownership of work we produce for a client is set out in that client's agreement. Our normal position is that the client owns the deliverables.
Third-party links
Where we link to another site, we do so for convenience. We do not control those sites and are not responsible for their content, their availability or their privacy practices.
Disclaimer and limitation of liability
This website is provided “as is”. To the fullest extent permitted by law, we disclaim all warranties in relation to it, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, Epsolon Inc. will not be liable for any indirect, incidental, consequential or special damages arising from your use of this website. Nothing in these terms limits liability that cannot lawfully be limited.
Liability in relation to services we perform is addressed in the applicable client agreement, not here.
Governing law
These terms are governed by the laws of the State of Texas and the United States, without regard to conflict of law principles. The courts of the State of Texas have exclusive jurisdiction over any dispute arising from them.
Changes
We may update these terms. The date at the top of this page shows when they last changed, and continued use of the site after a change means you accept the updated terms.
